Introduction

Relevant legal bases
In the following, we inform you of the legal basis of the General Data Protection Regulation (GDPR), on the basis of which we process personal data. Please note that in addition to the provisions of the GDPR, the national data protection regulations in your or our country of residence and domicile may apply. Should more specific legal bases also apply in individual cases, we will inform you of these in the privacy policy.
- Consent (Art. 6 para. 1 sentence 1 lit. a. GDPR) – The data subject has given their consent to the processing of their personal data for a specific purpose or several specific purposes.
- Performance of a contract and pre-contractual inquiries (Art. 6 para. 1 sentence 1 lit. b. GDPR) – Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
- Legal obligation (Art. 6 para. 1 sentence 1 lit. c. GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.
- Legitimate interests (Art. 6 para. 1 sentence 1 lit. f. GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.
Security measures
We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons, in order to ensure a level of protection appropriate to the risk.
The measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as access, input, disclosure, safeguarding availability and separation of the data. Furthermore, we have established procedures that ensure the exercise of data subject rights, the deletion of data and responses to data threats. Furthermore, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures in accordance with the principle of data protection, through technology design and data protection-friendly default settings.
SSL encryption (https): We use SSL encryption to protect your data transmitted via our online offering. You can recognize such encrypted connections by the prefix https:// in the address bar of your browser.
Transfer and disclosure of personal data
As part of our processing of personal data, data may be transferred to other bodies, companies, legally independent organizational units or persons or disclosed to them. The recipients of this data may include, for example, payment institutions in the context of payment transactions, service providers commissioned with IT tasks or providers of services and content that are integrated into a website. In such cases, we observe the legal requirements and, in particular, conclude corresponding contracts or agreements with the recipients of your data that serve to protect your data.
Data processing in third countries
If we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA)) or if the processing takes place in the context of the use of third-party services or the disclosure or transfer of data to other persons, bodies or companies, this will only take place in accordance with the legal requirements.
Subject to express consent or contractually or legally required transfer, we only process or have the data processed in third countries with a recognized level of data protection, contractual obligation through so-called standard protection clauses of the EU Commission, in the presence of certifications or binding internal data protection regulations (Art. 44 to 49 GDPR, information page of the EU Commission:

As part of the so-called “Data Privacy Framework” (DPF), the EU Commission has also recognized the level of data protection for certain companies from the USA as secure within the framework of the adequacy decision of 10.07.2023. The list of certified companies and further information on the DPF can be found on the website of the US Department of Commerce at https://www.dataprivacyframework.gov/. We will inform you which service providers we use are certified under the Data Privacy Framework as part of the data protection information.
Use of cookies
Cookies are small text files or other storage notes that store information on end devices and read information from the end devices. For example, to store the login status in a user account, the contents of a shopping cart in an e-shop, the content accessed or the functions used in an online offering. Cookies can also be used for various purposes, e.g. to ensure the functionality, security and convenience of online services and to analyze visitor flows.
Notes on consent: We use cookies in accordance with legal regulations. We therefore obtain prior consent from users, unless this is not required by law. In particular, consent is not required if the storage and reading of information, including cookies, is absolutely necessary in order to provide the user with a telemedia service expressly requested by them (i.e. our online offering). The revocable consent is clearly communicated to users and contains information on the respective use of cookies.
Information on the legal basis under data protection law: The legal basis under data protection law on which we process users‘ personal data with the help of cookies depends on whether we ask users for their consent. If users give their consent, the legal basis for processing their data is their declared consent. Otherwise, the data processed with the help of cookies is processed on the basis of our legitimate interests (e.g. in the business operation of our online offering and improving its usability) or, if this is done in the context of fulfilling our contractual obligations, if the use of cookies is necessary to fulfill our contractual obligations. We will explain the purposes for which we process cookies in the course of this privacy policy or as part of our consent and processing procedures.
Storage duration: With regard to the storage duration, a distinction is made between the following types of cookies
- Temporary cookies (also: session cookies): Temporary cookies are deleted at the latest after a user has left an online service and closed their end device (e.g. browser or mobile application).
- Permanent cookies: Permanent cookies remain stored even after the end device is closed. For example, the login status can be saved or preferred content can be displayed directly when the user visits a website again. The user data collected with the help of cookies can also be used to measure reach. If we do not provide users with explicit information on the type and storage duration of cookies (e.g. when obtaining consent), users should assume that cookies are permanent and can be stored for up to two years.
General information on revocation and objection (opt-out): Depending on whether the processing is based on consent or legal permission, you have the option at any time to revoke any consent you have given or to object to the processing of your data by cookie technologies (collectively referred to as “opt-out”). You can initially declare your objection using your browser settings, e.g. by deactivating the use of cookies (although this may also restrict the functionality of our online offering). Processing of cookie data on the basis of consent: We use a cookie consent management procedure in which the consent of users to the use of cookies or the processing and providers mentioned in the cookie consent management procedure can be obtained, managed and revoked by users. The declaration of consent is stored so that it does not have to be requested again and the consent can be proven in accordance with the legal obligation. Consent can be stored on the server and/or in a cookie (so-called opt-in cookie or with the help of comparable technologies) in order to be able to assign the consent to a user or their device. Subject to individual information on the providers of cookie management services, the following information applies: Consent may be stored for up to two years. A pseudonymous user identifier is created and stored with the time of consent, information on the scope of consent (e.g. which categories of cookies and/or service providers) as well as the browser, system and end device used.

We process the data of our contractual and business partners, such as customers and prospects (collectively referred to as „contractual partners“), within the framework of contractual and similar legal relationships, as well as associated measures, and in the context of communication with the contractual partners (including pre-contractual communication), e.g., to respond to inquiries.
We process this data to fulfill our contractual obligations, safeguard our rights, and for purposes related to administrative tasks and business organization. We only disclose the data of contractual partners to third parties within the scope of applicable law if it is necessary for the aforementioned purposes or to comply with legal obligations, or if the data subjects have provided their consent (e.g., to telecommunications providers, transport companies, auxiliary services, subcontractors, banks, tax and legal advisors, payment service providers, or tax authorities). Contractual partners are informed about additional processing, e.g., for marketing purposes, as part of this privacy policy.
We inform contractual partners about the data required for the aforementioned purposes before or during data collection, e.g., in online forms, through specific markings (e.g., colors) or symbols (e.g., asterisks), or personally.
We delete the data after the expiration of legal warranty or similar obligations, i.e., generally after 4 years, unless the data is stored in a customer account, e.g., as required by legal retention obligations (e.g., for tax purposes, typically 10 years). Data disclosed to us by the contractual partner as part of an order is deleted according to the order’s requirements, typically after the order has been completed.
If we use third-party providers or platforms to provide our services, the terms and privacy policies of the respective third-party providers or platforms apply in the relationship between the users and those providers.
Customer Accounts: Contractual partners can create an account within our online offering (e.g., customer or user account, referred to as „customer account“). If registering a customer account is required, contractual partners will be informed of this as well as the necessary details for registration. Customer accounts are private and cannot be indexed by search engines. As part of registration, subsequent logins, and use of the customer account, we store the customers‘ IP addresses along with the timestamps of access to verify the registration and prevent misuse of the customer account.
If customers terminate their customer account, the data related to the customer account will be deleted unless its retention is required by law. It is the responsibility of customers to secure their data after terminating their customer account.
Economic Analysis and Market Research: For economic reasons and to identify market trends, the preferences of contractual partners, and user needs, we analyze the data we have regarding business transactions, contracts, inquiries, etc. The group of affected individuals may include contractual partners, prospects, customers, visitors, and users of our online offering.
The analyses are conducted for the purposes of business evaluations, marketing, and market research (e.g., to determine customer groups with varying characteristics). If available, we may consider the profiles of registered users along with their data, e.g., regarding services used. The analyses are for our internal use only and are not disclosed externally unless they consist of anonymous analyses with aggregated, anonymized values. Additionally, we respect the privacy of users by processing data for analysis purposes as pseudonymously as possible and, where feasible, anonymously (e.g., as aggregated data).
Shop and E-Commerce: We process the data of our customers to enable them to select, purchase, or order the chosen products, goods, and related services, as well as to facilitate their payment and delivery or execution. Where necessary to fulfill an order, we engage service providers, particularly postal, freight, and shipping companies, to carry out the delivery or execution of the order for our customers.
For processing payment transactions, we use the services of banks and payment service providers. The required information is identified as such during the ordering or similar purchasing process and includes the data needed for delivery or provision and billing, as well as contact information for any necessary follow-up communication.

Payment Service Providers
As part of contractual and other legal relationships, due to legal obligations, or based on our legitimate interests, we offer affected individuals efficient and secure payment options. In addition to banks and financial institutions, we also use other payment service providers (collectively referred to as „Payment Service Providers“).
The data processed by the payment service providers includes inventory data, such as names and addresses, bank data, such as account numbers or credit card numbers, passwords, TANs, and checksums, as well as contract-related, total, and recipient-related details. This information is necessary to carry out transactions. The data entered is processed exclusively by the payment service providers and stored with them. This means we do not receive account or credit card-related information but only information confirming or rejecting the payment. In certain cases, the payment service providers transmit the data to credit agencies. This transmission is intended for identity and credit checks. For further information, we refer to the terms and conditions and privacy notices of the respective payment service providers.

Provision of the Online Offering and Web Hosting
To provide our online offering securely and efficiently, we utilize the services of one or more web hosting providers, whose servers (or servers managed by them) enable access to our online offering. For these purposes, we may use infrastructure and platform services, computing capacity, storage space, database services, security services, and technical maintenance services.
The data processed in the context of providing the hosting services may include all information related to users of our online offering that arises during use and communication. This regularly includes the IP address, which is necessary to deliver the content of online offerings to browsers, and all entries made within our online offering or websites.
Email Delivery and Hosting:
The web hosting services we use also include the sending, receiving, and storage of emails. For these purposes, the addresses of recipients and senders, as well as other information related to email delivery (e.g., the involved providers) and the content of the respective emails, are processed. The aforementioned data may also be processed for the purposes of SPAM detection. Please note that emails are generally not sent encrypted over the Internet. While emails are typically encrypted during transport, they are not encrypted on the servers from which they are sent and received unless end-to-end encryption is used. Therefore, we cannot assume responsibility for the transmission of emails between the sender and our server.
Collection of Access Data and Log Files:
We (or our web hosting provider) collect data about every access to the server (so-called server log files). Server log files may include the address and name of the accessed web pages and files, the date and time of access, the amount of data transferred, confirmation of successful access, browser type and version, the user’s operating system, the referrer URL (the previously visited page), and usually the IP address and the requesting provider.
Server log files may be used for security purposes, e.g., to prevent server overloads (especially in the case of abusive attacks, such as DDoS attacks), and to ensure server capacity and stability.

Newsletter and Electronic Notifications
We send newsletters, emails, and other electronic notifications (hereinafter referred to as „Newsletters“) only with the recipient’s consent or legal permission. If the content of the Newsletter is specifically described during the registration process, it is decisive for the user’s consent. Otherwise, our Newsletters include information about our services and us.
To sign up for our Newsletters, it is generally sufficient to provide your email address. However, we may ask for a name for the purpose of personalizing the Newsletter or additional information if required for the Newsletter’s purposes.
Double-Opt-In Procedure:
Newsletter registration is conducted using a double-opt-in procedure. This means you will receive an email after registration asking you to confirm your subscription. This confirmation is necessary to ensure that no one can register with someone else’s email address. Newsletter registrations are logged to verify the registration process as required by law. This includes storing the registration and confirmation times as well as the IP address. Changes to your data stored with the email service provider are also logged.
Deletion and Restriction of Processing:
We may store unsubscribed email addresses for up to three years based on our legitimate interests to prove prior consent. The processing of this data is restricted to the purpose of potential defense against claims. A request for individual deletion is possible at any time, provided the previous existence of consent is confirmed. In case of obligations to permanently respect objections, we reserve the right to store the email address solely for this purpose in a suppression list (commonly referred to as a „blacklist“).
The logging of the registration process is based on our legitimate interests to demonstrate its proper implementation. If we engage a service provider for email delivery, this is based on our legitimate interest in an efficient and secure mailing system.
Legal Basis Information:
Newsletter dispatch is based on the recipient’s consent or, if consent is not required, on our legitimate interest in direct marketing, as long as it is permitted by law (e.g., in the case of customer advertising). If we engage a service provider for email delivery, this is also based on our legitimate interests. The registration process is recorded based on our legitimate interests to prove that it was conducted in compliance with the law.

Analysis and Performance Measurement:
The Newsletters contain a „web beacon,“ i.e., a pixel-sized file retrieved from our server or, if we use a service provider, from their server when the Newsletter is opened. During this retrieval, technical information such as browser and system information, IP address, and time of retrieval is collected.
This information is used to improve our Newsletter based on technical data or target groups and their reading behaviors, determined by retrieval locations (identifiable via IP address) or access times. The analysis also includes determining whether Newsletters are opened, when they are opened, and which links are clicked. While this information can technically be assigned to individual Newsletter recipients, it is neither our intention nor, if used, that of the service provider to observe individual users. Instead, the evaluations help us understand our users‘ reading habits and adapt our content or send different content according to their interests.
The analysis of the Newsletter and performance measurement is conducted, subject to the users‘ explicit consent, based on our legitimate interests in using a user-friendly and secure Newsletter system that serves our business interests and meets users‘ expectations.
A separate revocation of the performance measurement is unfortunately not possible. In such cases, the entire Newsletter subscription must be canceled or objected to.

Webanalyse, Monitoring und Optimierung
Die Webanalyse (auch als „Reichweitenmessung“ bezeichnet) dient der Auswertung der Besucherströme unseres Onlineangebotes und kann Verhalten, Interessen oder demographische Informationen zu den Besuchern, wie z.B. das Alter oder das Geschlecht, als pseudonyme Werte umfassen. Mit Hilfe der Reichweitenanalyse können wir z.B. erkennen, zu welcher Zeit unser Onlineangebot oder dessen Funktionen oder Inhalte am häufigsten genutzt werden oder zur Wiederverwendung einladen. Ebenso können wir nachvollziehen, welche Bereiche der Optimierung bedürfen.
Neben der Webanalyse können wir auch Testverfahren einsetzen, um z.B. unterschiedliche Versionen unseres Onlineangebotes oder seiner Bestandteile zu testen und optimieren.
Zu diesen Zwecken können sogenannte Nutzerprofile angelegt und in einer Datei (sogenannte „Cookie“) gespeichert oder ähnliche Verfahren mit dem gleichen Zweck genutzt werden. Zu diesen Angaben können z.B. betrachtete Inhalte, besuchte Webseiten und dort genutzte Elemente und technische Angaben, wie der verwendete Browser, das verwendete Computersystem sowie Angaben zu Nutzungszeiten gehören. Sofern Nutzer in die Erhebung ihrer Standortdaten eingewilligt haben, können je nach Anbieter auch diese verarbeitet werden.
Es werden ebenfalls die IP-Adressen der Nutzer erhoben. Jedoch nutzen wir ein IP-Masking-Verfahren (d.h., Pseudonymisierung durch Kürzung der IP-Adresse) zum Schutz der Nutzer. Generell werden die im Rahmen von Webanalyse, A/B-Testings und Optimierung keine Klardaten der Nutzer (wie z.B. E-Mail-Adressen oder Namen) gespeichert, sondern Pseudonyme. D.h., wir als auch die Anbieter der eingesetzten Software kennen nicht die tatsächliche Identität der Nutzer, sondern nur den für Zwecke der jeweiligen Verfahren in deren Profilen gespeicherten Angaben.

Web analysis (also referred to as „reach measurement“) is used to evaluate visitor traffic to our online offering and may include pseudonymous data about visitors, such as behavior, interests, or demographic information (e.g., age or gender). With the help of reach measurement, we can identify, for instance, the times when our online offering or its features or content are most frequently used or revisited.
